WHEN SILENCE BECOMES LAW: MANTICA’S GREAT TREATISE ON TACIT AND AMBIGUOUS AGREEMENTS ABSTRACT Important treatise of Roman and canonical law on tacit and ambiguous conventions and on the interpretive difficulties of contracts. Francesco Mantica, one of the greatest Italian jurists between the fifteenth and seventeenth centuries and later a cardinal, systematically addresses the cases in which the parties’ will is not expressed clearly. The work, structured in twenty-seven books, analyzes negotiations, contracts, donations, conditions, obligations, and the interpretation of legal will. This 1645 edition, in two large folio volumes, reissues one of the most authoritative texts of European jurisprudence of the time. A parchment exemplar from the period, with widespread browning and the first volume partially detached from its binding, but complete and of notable historical-legal interest. WHY TO BUY MAJOR WORK OF EARLY MODERN LAW – One of Francesco Mantica’s principal works, dedicated to the interpretation of tacit and ambiguous conventions in legal relationships. 27-BOOK LEGAL SYSTEM – The treatise is organized into twenty-seven books and systematically tackles the main forms of bargains and obligations. AUTHORITATIVE JURIST AND CARDINAL – Mantica was a professor at Padua, a judge of the Rota, and a cardinal; Treccani regards him as one of the most eminent jurists of his time. COMPLETE TWO-VOLUME SET – The two tomes preserve the complete structure of the work, with indices and final apparatus, in folio format with uniform bindings. MARKET VALUE The sixteenth- and seventeenth-century editions of Mantica are not rare in absolute terms in major libraries, but complete two-volume folio copies, especially in period bindings, retain steady interest for collectors of ancient law, canon law, and the history of jurisprudence. For the present exemplar, considering the two-volume completeness and the period bindings, a commercial range of about €300–500 is estimated. PHYSICAL DESCRIPTION AND CONDITION Period bindings in full parchment, soft, with handwritten titles on the spine: “Mantica de Tacitis et Ambiguis,” Tom. 1 and Tom. 2. The ties are preserved. The first volume presents a binding partially detached from the body of the book, with the front hinge weakened. Parchment with stains, abrasions, and signs of use. Internals browned, with physiological foxing and some stains. The second volume shows better structural conditions, but with similar browning and foxing of the paper. Both volumes bear the true frontispiece. Volume I has the title in red and black and a large central woodcut crest; Volume II has its own typographic frontispiece. Text in Latin arranged in two columns, with dense marginal citations, ornate initials, headpieces, tailpieces, and index apparatus. In ancient books, with a multi-century history, a few imperfections may be present, not always noted in the description. This listing contains AI Visualizations. Refer to the original photographs to verify the object’s actual condition. Images are an integral part of the description. Pp.: Vol. I: (4); 12nn; 762; (6). Vol. II: (4); 8nn; 736; 146; (4). FULL TITLE AND AUTHOR Vaticanae lucubrationes de tacitis et ambiguis conventionibus, in libros XXVII dispertitae. Tomus Primus – Tomus Secundus. Sumptibus Iacobi Crispini, 1645. Francesco Mantica. CONTEXT AND SIGNIFICANCE The core of the work is the problem of interpreting the will when it has not been expressed clearly. Mantica studies all those situations in which a contract, a donation, a promise, a condition, or a legal disposition presents obscure, incomplete, or implicit formulas. The treatise arose as a natural development of the preceding De coniecturis ultimarum voluntatum, dedicated to the interpretation of testamentary will. In Vaticanae lucubrationes the field is widened to relations between the living and private conventions. Mantica distinguishes general cases from specific fact patterns, bringing together Roman law, canon law, the doctrine of the glossators and commentators, judicial practice, and casuistic interpretation. The work was particularly important because it sought to establish criteria to reconstruct what the parties had actually intended when words were not enough. The theme remains central today in contract law: interpretation of will, good faith, meaning of clauses, and conduct as evidence. BRIEF BIOGRAPHY OF THE AUTHOR Francesco Mantica was born in Pordenone in 1534 and died in Rome in 1614. He studied law in Bologna and Padua and taught civil institutions at the University of Padua. He was then summoned to Rome as a judge of the Sacred Rota. In 1596 Clement VIII elevated him to the cardinalate. He was considered, together with Iacopo Menochio, one of the most important Italian jurists of his time, and his works had great authority in the courts. His two main works were De coniecturis ultimarum voluntatum and Vaticanae lucubrationes de tacitis et ambiguis conventionibus. Treccani notes that the Lucubrationes were written during the Roman period and first published in Rome in 1609. PRINTING HISTORY AND CIRCULATION The first edition of Vaticanae lucubrationes appeared in Rome in 1609 at the Vatican Press. Google Books lists the first volume with 776 pages. A second Roman edition appeared in 1613 at Curzio Lorenzini; the UNAM catalog describes it in two volumes with [16], 776 pages and [8], 736, [202] pages. Subsequent European editions are documented, including the 1615 Geneva edition at Pierre de La Rovière. The 1645 edition, here present, is labeled on the title page as Editio postrema. Google Books records the two volumes of 1645 separately, with 762 pages for the first and 896 pages digitized for the second. The continuous reprinting of the work throughout the seventeenth century testifies to its long use as a reference text in European legal practice.
